The terms and conditions governing the use of the BigToyShed.com website (the "website") are detailed below and should be read carefully. We may vary these terms from time to time. Any such changes will take effect when posted on the website and it is your responsibility to read these terms on each occasion you use this website or before you make a new purchase . If any of these terms are deemed invalid, that term will be deemed severable and will not affect the validity and enforceability of any remaining terms provided that the contract will still make sense.

Any use by you of this website or purchase made through this website means that you accept these terms and conditions in their entirety. Do not rely on promises or claims written or verbally made by anyone other than BigToyShed.

Any contracts or agreements formed between you and us by means of this website shall be governed and interpreted according to English law and any disputes or proceedings shall be subject to the exclusive jurisdiction of the English courts. English is the only language offered for the conclusion of the contract.

Online Shopping

We have taken care in presenting the products on our website as accurately as possible. The images you see will depend on your monitor's display and colour capabilities. We are therefore unable to guarantee that the product images you see are an accurate representation of the actual merchandise. Before you place an order you should read the following: Orders, Delivery Information, Returns Policy and Privacy Policy. These pages form part of these terms and conditions and contain important information about your order.

Orders and Dispatch

• Your order represents an offer to us to purchase a product. Once you have completed an online purchase, if we are able to accept your order, we will send you an email confirming receipt of your order and the order details. At that point a binding agreement between us will exist. In certain circumstances, as those explained in paragraphs 8 and 10 below, it will be possible for either you or us to cancel the order. Please read those paragraphs for more information.
• We will only take payment from you once your credit card is authorized.
• Whilst we are under no obligation to accept your order, we would normally do so where (i) the product is available, (ii) the order reflects current pricing and (iii) your credit card/debit card payment is approved by your credit card/debit card company.
• Unfortunately we cannot accept orders from persons under the age of 18.
• You can access details of your order and any previous orders you may have made by signing-in to your account. We do recommend however that you print out these terms and conditions and the order acknowledgement for your records.

When can I expect my orders to arrive?

All orders received through the website are processed and, if we accept your order by sending you a confirmatory email, dispatched within 2-3 working day of us receiving the order. Therefore, depending on the delivery option that you select, your products will usually be with you in just a few days.. Any orders received after 12 noon on Friday will be dispatched the following week.

Deliveries are made between 8am and 6pm, Monday to Friday (excluding Bank Holidays). For orders placed at anytime on Saturday or Sunday, the earliest delivery date will be Wednesday.

Any product that is out of stock is displayed as such on the website and you will not be able to order that product until it is back in stock.

If you wish, you can provide us with an alternative delivery address, just let us know when ordering by filling in the delivery address on the order page.

Please note that a signature is required from an adult aged 18 years or over at the time of delivery for all types of orders.

Why would my contact address be different to my delivery address?

In some instances the products you order will be delivered by courier. If no one will be able to sign for the products at your contact address you may wish to have them sent to an address where someone will be able to accept them during normal business hours (e.g. a work address).

If the products you order are intended for a gift you may wish to have the goods delivered directly to the gift recipient, but have the receipt sent to your own address.

Can I track my order once it has been dispatched?

Orders are dispatched using our partner courier service provider or via Royal Mail. A consignment number will be available upon request.. If a consignment number appears against a product in your order, simply click on the number and you will be directed to the partner couriers service providers website where you can see the delivery status of your order.

Prices and charges

We try to ensure that all product information and pricing displayed on this website is correct and up to date at the time you place an order. We verify pricing at dispatch, and in the event that we discover an error in the price of the products you have ordered, the following terms will apply:

• If actual price is lower than the price shown on this website at time of ordering we will charge you the lower amount and dispatch the product.
• If actual price is higher than the price shown on this website at time of ordering at our discretion, we will either contact you as soon as possible to discuss whether you wish to continue with the order, or cancel the order and send you an email confirming the cancellation. If we are unable to contact you within 14 days of the placing of the order we will treat the order as cancelled. If the order is cancelled and you have already paid for the products, you will receive a full refund.

All prices shown on the website are in pounds sterling and inclusive of VAT.

Prices exclude delivery charges which are shown as a separate line item on the order summary page.

Delivery Options and Charges

Shipping charges will be shown in the final invoice and based upon the following weights.

501 - 1000 g	£3.50
1001 - 1250 g	£4.50
1251 - 1500 g	£5.00
1501 - 1750 g	£6.00
1751 - 2000 g	£6.50
2001 - 4000 g	£8.00
4001 - 6000 g	£10.50
6001+ g	£13.00

These rates allow for packaging of 25 - 50g per item

Delivery will be 3 - 5 working days, from the day that you place your order.

Please note: We advise you to check the description of the product you wish to order, some larger items may take longer than our standard delivery option to arrive, generally these items will be free delivery. Please ensure that someone is available to sign for your order upon delivery, if not this may result in a delay to the specified delivery time scale.

We make every effort to deliver your order within the specified timescales, however, where it is not possible to meet these timescales due to unforeseen circumstances which are beyond our reasonable control, we will notify you and advise you of an anticipated delivery date. This does not affect your statutory rights.

Orders to Northern Ireland and Scottish Isles are charged at £11.99.

Risk of loss and damage of products passes to you on the date when the products are delivered, or on the date of the first attempted delivery by us, provided that we have processed and received payment in full for the products.

Delivery Address

All deliveries will be made to you at the address specified by you in the order. We may, at our discretion and expense (if there is any additional expense over the cost of delivering the order all at one time), deliver parts of your order separately. If we cannot deliver the products to you at the address you have specified for any reason, we will notify you and store the products. If you wish us to redeliver the products to you, you will need to authorise us to charge your credit card/debit card for such re-delivery. If we do not hear from you within 28 days, we will cancel the order and refund your payment to you, less any reasonable delivery charges we have incurred.

A signature from an adult aged 18 years or over will be required to receive the order. Ownership of the products shall pass to you once the products have been delivered to you and we have received payment in full, in cleared funds.

Should you decide to have your order delivered to a different address than your own, a signature will still be required and the general conditions of delivery will remain unchanged.

Returns Policy

In the unlikely event that you receive a faulty or damaged item, BTS will provide a full refund or exchange, but we ask that you notify us of this within 7 days of receipt of the product. Our promise to replace the item or provide a refund does not apply to faults or damages caused by accident, neglect or misuse.

If you are unhappy with a product you have purchased, you may return the product within seven days of delivery and a refund will be provided. All products must be returned in the original packaging and in a re-saleable condition (with any seals or wrapping unbroken). You are responsible for costs in returning any unwanted items.

To return an item, please email us to obtain a Returns Authorisation Number; without this we are unable to accept any returns.

Cancellations

Under the Consumer Protection Regulations, you have the right to cancel your order with us at any time within 7 days of receiving your goods.

In the event we are unable to deliver your order within our standard delivery timescales you are entitled to cancel your order with no penalty.

Should you cancel the contract we will then refund you the price you have paid for the goods, this will not include delivery charge if you have cancelled after your order has been dispatched, also not a service provided by us, such as a special delivery service. You are under a duty to take reasonable care of the goods, which means the goods must be unused. Please contact our Customer Service Team should you wish to cancel your order.

Privacy Policy

All personal information given to us through this website will only be held and used with care and in accordance with this policy and the Data Protection Act 1998. Your use of this website constitutes your agreement to the terms of this Privacy Policy.

Use of Personal Information and Your Preferences
